Law Firm Requests Urgent Investigation into Simon Kabu for Alleged Threats and Firearm Misuse

A prominent law firm, Mwenda Njagi & Co. Advocates & Mediators, has formally requested the Directorate of Criminal Investigations (DCI) to initiate a criminal investigation into Mr. Simon Kabu. The allegations include threats, intimidation, and the reckless use of a firearm against his estranged spouse, Ms. Sarah Njoki Nyaga.

In a letter dated December 5, 2024, addressed to the DCI and circulated online, the law firm detailed a series of incidents allegedly perpetrated by Mr. Kabu. The letter highlights a disturbing pattern of calculated malice, characterized by explicit threats, psychological abuse, and misuse of a firearm.

Key Allegations:

  1. Threats and Intimidation: Mr. Kabu is accused of making explicit threats to Ms. Nyaga, including a statement implying that he would not be to blame if she were found dead along Kiambu Road. Witnesses are reportedly willing to testify to these threats.
  2. Firearm Misuse: Ms. Nyaga discovered a firearm recklessly placed within their home, accessible to their children. The firearm had neither been disclosed to her nor its registration established. The law firm argues that this recklessness justifies an investigation into whether the firearm is legally registered and whether Mr. Kabu is competent to hold it.
  3. Psychological Abuse: Mr. Kabu allegedly brandished the firearm during an altercation and even carried it to their daughter’s birthday party, demonstrating a disregard for safety. Additionally, he took their children to clean a grave without Ms. Nyaga’s knowledge, a move she perceived as calculated intimidation.
  4. Defamation and Cyber Harassment: The letter accuses Mr. Kabu of using proxies, including the YanguNI Yangu blogger, to disseminate defamatory and malicious content aimed at tarnishing Ms. Nyaga’s reputation. This included edited CCTV footage depicting events at their matrimonial home, which allegedly omitted key aspects and was manipulated to cast Ms. Nyaga in a negative light.
  5. Economic Sabotage: Mr. Kabu is also accused of establishing a competing business, Adequate Safaris, aimed at undermining Bonfire Adventures, a venture co-founded by Ms. Nyaga. The timing of the defamatory content’s release appears intended to overshadow the launch of Ms. Nyaga’s Virtuous Women Foundation, scheduled for December 7, 2024.

Call for Action:

Mwenda Njagi & Co. Advocates & Mediators have urged the DCI to:

  • Investigate the registration, ownership, and misuse of the firearm, with a view to revoking the firearm license if applicable.
  • Open a case file to investigate Mr. Kabu’s threats, intimidation, and psychological abuse against Ms. Nyaga, in violation of the Penal Code and the Computer Misuse and Cybercrimes Act, 2018.
  • Address the defamation and cyber harassment orchestrated through his proxies.

The letter also references ongoing divorce proceedings and a related children’s case at the Kiambu Magistrate Court, emphasizing the need for urgent intervention to protect Ms. Nyaga and her children from further harm.
